We provide a Broadband Satellite Internet service including related e-mail, help desk and other services. IP addresses will be dynamically and not statically assigned to you. The Service is available in select communities where site conditions permit. We provide the Service on a “best efforts” basis and does not guarantee upload or download speeds. Service speed can vary depending on location, weather, inside wiring, Internet traffic, and other factors beyond our control. The Fair Access Policy ensures equitable access for all Subscribers. To ensure this equity, customers may experience some temporary throughput limitations. This policy applies to all service plans.|
||CHANGES TO SERVICE. We reserve the right to change the Service, the monthly fees or administrative charges at any time upon 30 days notice. You understand that if there is a change in satellite facilities, you may be required to realign and/or relocate your receiving antenna at your own expense in order to continue to receive the Service.|
||TERM. This Agreement will begin upon the activation of the Services and will continue for the number of months specified on your contracted Service Agreement. This charge will be applied to all amounts remaining unpaid, one month after the date of the invoice.|
||PAYMENTS. You authorize us to charge the Fees to the credit card by way of the pre-authorized payment plan that you specify when you purchase the Services. The automatic billing will be made each month, one month in advance and partial months are pro-rated on a daily basis. You are responsible for any fees for overdrawn accounts, exceeding credit card limits, or similar expenses resulting from automatic billing. Delinquent accounts may be suspended or cancelled in our sole discretion; however, Fees will continue to accrue until the account is cancelled. We may bill an additional charge to reinstate a suspended account. If you have questions regarding your account, you should contact our Customer Service Centre at 1- 877-991-5600. All charges are considered valid unless disputed in writing within 30 days of the billing date. Adjustments will not be made for charges that are more than 30 days old.|
||EARLY CANCELLATION. |
a) You may cancel this Agreement by giving notice of cancellation not later than 10 days after the date you receive your equipment. If you chose not to accept the Terms of Service within the 10 days grace period, you can return the equipment prior to installation and cancel this Agreement without any early termination charge; however, you will be charged a restocking fee of $150 for the return of equipment. This charge has been calculated to cover all shipping and administration costs for your cancelled order.
b) You may cancel your subscription to the Service and terminate this Agreement at any time after installation. In the event of any such termination, you agree to pay Netkaster an early termination charge based on the remaining value of your subscription package, as follows:
